Here is where I come down. Blanche is wrong on the history, and he is wrong on Garland.

On the history: the line between the White House and particular cases was written down after Watergate by people who paid for it. Richardson gave up his office over it. Levi and Bell put it in memos and speeches. Garland put it in the department’s manual, where it still sits.

The question

Five speeches, three tests. Every leader on this list paints in light and dark. The test is who ends up standing in the dark.

This week’s question: when a leader draws the line between light and dark, who does he put on the dark side of it?

The answer separates the speeches a country carves into stone from the speeches historians keep as evidence. Defenders of self-government point the dark at a regime, an ideology, a sin the whole nation shares, or the power of their own institutions. Then they ask the listener to carry something. Autocrats point the dark at the neighbors and ask the listener to watch them.

The opening page

June 18, 1940, the House of Commons. The day before, France had asked Germany for terms. Winston Churchill closed his report with the most famous light and dark in modern English:

“If we can stand up to him, all Europe may be free and the life of the world may move forward into broad, sunlit uplands. But if we fail, then the whole world, including the United States, including all that we have known and cared for, will sink into the abyss of a new Dark Age made more sinister, and perhaps more protracted, by the lights of perverted science.”

Look at who stands in the dark. “Him” is Hitler, across the Channel. The dark itself is a future the British people could still refuse. Nobody sitting in that chamber stands in it.

Wednesday night in San Antonio, a president drew his own line, speaking of Democratic-run states: “when the blues get in, everything becomes dirty. The streets are dirty. 1. Lincoln, March 4, 1865: the dark belongs to everyone

Lee would surrender at Appomattox five weeks later. By the standards of any war, Lincoln had earned the right to cast the South as the darkness. He did the reverse. “Both read the same Bible and pray to the same God, and each invokes His aid against the other.” He named slavery as the offense and gave the war “to both North and South” as “the woe due to those by whom the offense came.” The dark falls on the whole nation, the winning side included.

Then the ask: “With malice toward none, with charity for all, with firmness in the right as God gives us to see the right, let us strive on to finish the work we are in, to bind up the nation’s wounds, to care for him who shall have borne the battle and for his widow and his orphan.”

The Department of Veterans Affairs built its motto from that sentence. I do my best not to carry malice toward any American. I do, however, recognize behaviors. Finishing that work, to me, means healing each other, working together, supporting each other, and taking care of our veterans.

Where the dark points: at a sin the whole country shares. What he asks: bind wounds, care for the people who fought. Where he stands: under the same judgment as everyone else. “Let us judge not, that we be not judged.”

2. Churchill, June 18, 1940: bad news first, then the light

Before the uplands, Churchill gave the House the defeat himself: “in the first two of those weeks the battle in France has been lost.” And: “What General Weygand called the Battle of France is over. I expect that the Battle of Britain is about to begin.” A defender tells you the bad news in his own voice before he asks anything of you.

After he retired, he said of his service: “I suspected I was just part of a racket at the time. Now I am sure of it.” Eisenhower gave his warning on his way out of office. A warning from inside carries weight because the speaker has been there. The citizen’s job is to tell a map that explains reality from a map that sells it.

Where the dark points: an ideology abroad, and unchecked power at home, his own side’s included. What he asks: stay alert and informed. Where he stands: leaving office, handing the watch to you.

4. Hitler, Stalin, Putin: the dark moves inside

On Iran, he points the dark where the first three pointed it. “I am ensuring that Iran will never have a nuclear weapon,” he said in San Antonio, and less than two minutes later: “We protect our cities. We protect our country.” The dark is a regime abroad. The ask, from Monday in Nebraska, is a cost at the pump. That day he told News Channel Nebraska that fuel prices are “a relatively small price to pay for keeping nuclear weapons out of the hands of a lunatic nation.”

On Wednesday, an assistant secretary at the Pentagon signed a one-page letter to Sen. Elissa Slotkin of Michigan. In the third paragraph he cited a federal law that dates to 1865.

That law makes it a crime for a federal officer to bring “troops or armed men” to any place where an election is held. The letter says the Department of War operates “in strict compliance” with it.

The letter is the newest page in a record that runs back to February. My Sunday post about the “final battle” ad drew 71 comments. My readers asked about money, about the networks, and about November. This Binding takes the November question, because I can answer that one with what is on the record.

Here is the question the five picks below share: thirty-two days out, who has put it in writing that armed federal agents will stay away from your polling place, and which page binds them?

Four of these pages come from the executive branch, which answers to the President. One comes from Congress, and it is the oldest. I read each one with the two-level reading from Monday’s chapter: what the page says, set beside what it binds anyone to do.

1. Assistant Secretary of War Mark Ditlevson, letter to Sen. Elissa Slotkin, September 30, 2026.

Slotkin wrote to Secretary Pete Hegseth and Gen. Dan Caine on Aug. 18. She asked both men to confirm in writing that the military will stay out of the midterms.

Caine, the chairman of the Joint Chiefs, answered on Aug. 28: “The Joint Force has no plans to send Federal military personnel or Federalized members of the National Guard to polling places during the 2026 elections.” He added a sentence you should save somewhere: “I have neither received nor anticipate receiving any unlawful order concerning the role of the Joint Force in the upcoming November 2026 midterm elections.”

The department’s answer came 43 days after her letter. Mark Ditlevson signed it as Assistant Secretary of War for Homeland Defense and Americas Security Affairs. The core sentence: “the Department has no plan to deploy active-duty troops or Federalized National Guard to polling sites, nor does it have any plan to interfere with ballots, voting machines, or other election-related materials.”

The next sentence matters even more. “We operate in strict compliance with Federal law, including 18 U.S.C. § 592 and 18 U.S.C. § 593, which expressly restrict the presence of military personnel at election sites and criminalize interference with election officials or materials.”

Then the letter looks ahead, to the day another agency asks the Pentagon for help. Any such support “will be in strict compliance with the law and will not interfere with the voting process or create the perception of military involvement in the administration of elections.”

Read the letter before you read the press release about it. Slotkin’s office ended its headline with “Hegseth Silence Continues.” That holds in one narrow sense: the Secretary did not sign it. The letter itself says more than Secretary Mark Esper said when Slotkin put a similar question to him in 2020. Asked in writing whether he would refuse an order to send active-duty troops to polling places, Esper answered: “The U.S. military has acted, and will continue to act, in accordance with the Constitution and the law.” Slotkin said then that a question this serious deserved a response “in a declarative way.” This week’s letter is declarative, and it names the statute.

A correction from me. On Monday, in a Substack Note and in a comment under the “final battle” post, I quoted her office’s Sept. 2 statement that Hegseth “has yet to respond.” On Wednesday the department responded. This letter is the newer record, and it goes on the page beside the old one.

The rest of the release reads heavier than the memo. It says the memo directs the department “to mobilize a comprehensive, whole-of-government defense of our election infrastructure from foreign adversaries.” Spokesman Sean Parnell goes even further: “By working in lockstep with federal, state, and local partners, U.S. Cyber Command and our defense intelligence teams will defend the integrity of America’s voting systems.”

State and local officials run America’s voting systems. The memo the Secretary signed does not mention them. The release added them.

Read the memo for what it orders and the release for what it claims. The order points outward, at foreign actors, and nothing in it reaches a polling place. That is how it should read. The answer to the question Slotkin asked, about troops at the polls, came from a different desk: the office that handles homeland defense, in pick one.

3. Homeland Security, on three dates: February 25, June 2 and September 1, 2026.

Homeland Security runs ICE. Its agents carry guns and work inside the country, which puts this department closer to the polling-place question than any office in the Pentagon. Its record comes in three dates.

February 25. Heather Honey, the Homeland Security official in charge of election integrity, spoke on a call with state election officials. NPR reported her words: “There will be no ICE presence at polling locations.” And: “Any suggestion that ICE is going to be present at polling places is simply disinformation.”

June 2. Primary day in California. At 8:15 a.m., ICE vehicles pulled into the parking lot of the vote center at the Rancho Simi Recreation and Park District Activity Center in Simi Valley. The Ventura County Star reported that the agents stayed about 30 minutes and did not enter the voting area. Simi Valley police said they had no advance notice. Homeland Security said: “For operational security reasons, we are not going to confirm the locations of our officers.” Nothing in the record says why they were there, and I will not guess.

September 1. Secretary Markwayne Mullin, at a news conference in New York: “ICE isn’t there to patrol the polling places. We’re there to enforce specific threats.” Then: “The only reason why we would be at polling places is if there is a threat to that polling place or we’re serving a warrant on someone that we have been actively tracking down.”

In 188 days the department’s promise moved from “no presence” to “only if.” Both came from the same department, six months apart. The second carries two exceptions the first did not.

Slotkin put the same question to Mullin in writing on Sept. 2. As of Oct. 1, her office says he has not answered.

The FBI also puts armed agents to work inside the country. Slotkin wrote to Patel, and to Attorney General Todd Blanche above him, on Sept. 2. Her office says neither has answered.

Patel did speak to the question in public, before that committee on Sept. 15. Sen. Richard Blumenthal of Connecticut asked him to commit that FBI agents would stay away from the polls in November. Amy Klobuchar of Minnesota whether he knew the Justice Department’s policy limiting FBI work at polling places on Election Day: “We will always follow the law and the guidelines.” And to Blumenthal: “I’m telling you we’re going to house our agents and intel analysts in our field offices for election security.”

At least one headline compressed this into a director who won’t commit to obeying the law. Read his words whole. He committed to the law and told the Senate where his people will sit.

Read this one last. It is a single sentence, and it binds every official in the first four picks:

“Whoever, being an officer of the Army or Navy, or other person in the civil, military, or naval service of the United States, orders, brings, keeps, or has under his authority or control any troops or armed men at any place where a general or special election is held, unless such force be necessary to repel armed enemies of the United States, shall be fined under this title or imprisoned not more than five years, or both; and be disqualified from holding any office of honor, profit, or trust under the United States.”

Congress first passed it in 1865, “amid the Civil War on a bipartisan basis,” in the Brennan Center’s account. Look at who it covers: an officer of the Army or Navy, or any “other person in the civil, military, or naval service.” Look at what it covers: “troops or armed men.” The Brennan Center reads that to mean the law “bans federal law enforcement agents, not just troops.” PolitiFact reports that Jonathan Diaz, a lawyer at the Campaign Legal Center, reads “armed men” the same way, ICE included.

The original law carried a second exception. Federal force could come to the polls to keep the peace. In 1909 Congress struck that exception, the Brennan Center writes, “at least in part because it feared that federal authorities could point to any kind of disturbance as a pretext to deploy troops.”

Now set the two side by side. Congress, 1909, writing “keeping peace at the polls” out of the law. Secretary Mullin, 2026: “if there is a threat to that polling place.” I am not a lawyer, and I will not tell you those two lines mean the same thing. I will tell you Congress weighed that kind of exception once, 117 years ago, and took it out.

I voted absentee for all twenty-three years I served in the Marine Corps, from stateside posts and from overseas, on the federal postcard. The Secretary’s own video on Sept. 25 pointed troops to that same postcard at FVAP.gov. The Marine Corps taught me that the law is not a suggestion and that an election is personal: the vote is yours. I voted in the 2008 election while I was stationed on Okinawa, Japan. No one stopped me then, and no one should stop me now.

A ballot from a Marine overseas and a voter walking into a community center in Simi Valley are protected by the same kind of thing: a page, written by Congress, with a penalty attached.

Find the sentence. Skip the headline and the release. Open the page itself and find the one sentence that answers the question you care about.

Circle the verb. “Haven’t thought of it.” “Has no plan.” “Will.” “Shall.” Each makes a different kind of promise.

Ask what would change it. A thought can change overnight. A plan changes with one decision. A commitment in a letter changes with the next letter. A “shall” in federal law changes only by a new act of Congress.

Landing

Five pages, and the verbs on them tell you how much power each one holds.

The Pentagon wrote “has no plan” about troops at the polls and “will not” about the help it gives other agencies, and it named § 592. The Secretary signed an order that says “foreign” in every directive. Homeland Security said “will be no” in February and “only if” in September. The FBI director said “will follow the law” and “I don’t know that we can’t.” Congress wrote “shall” and has kept the ban on the record since 1865.

Every agency here answers to one man. TIME asked the President on Sept. 28 whether he plans to send ICE agents to polling places in the midterms. His answer: “Haven’t thought of it.”

TIME asked him a second question: would he rule out declaring a state of emergency before the midterms, short of widespread violence in the streets? “I don’t rule anything out or in. We’ll see. You mean the Insurrection Act? No, I’ve never used it. I could use it. A lot of people think I should use it sometimes.”

Does that law open a door the 1865 page closes? Two Lawfare editors, Loren Voss and Natalie K. Orpett, argued on Sept. 30 that it does not. A specific statute like the troops-at-polls ban, they write, “will not be controlled by a general statute, such as the authority given under the Insurrection Act, unless Congress indicates that result.” They also put the other side on the page: a 1968 opinion from the Justice Department’s own lawyers “concluded § 592 did not restrict the president’s authority under the Insurrection Act.” And they say plainly that “courts have yet to weigh in on how the two laws interact.”

No court has settled it. That is the record as it stands, and you should know both sides of it.

The page with the penalties is the oldest one, and the Pentagon’s own letter points to it.

That leaves one plain ask, and the record supports it. On Sept. 2, Slotkin sent the Pentagon’s question to the Justice Department, Homeland Security and the FBI. All three command or oversee armed agents who work inside the country. Each can answer the way the Pentagon did: on paper, signed, with § 592 named. It only costs them one page.

Your polling place is run by your county, under your state’s law. Read the page before you read the release about it. Then hand the page to someone who will vote in person.

Stephen Richer and Gina Goldenberg, “ICE at the Polls: Not the Hottest Election Threat,” Democracy Project, September 10, 2026.

Richer is the former Republican recorder of Maricopa County, Arizona, the office that handles voter registration and early voting there. He and Goldenberg argue that “the highly decentralized nature of our elections, plus the massive growth of early voting, combined with a strong legal framework, would make widespread ICE interference a heavy lift for the federal government.” Then they name the danger they do see: “Ironically, it’s possible that the real voting deterrent might be the perceived inevitability of ICE at the voting locations.”

I include this because a piece like this one could become that deterrent. Five pages about armed agents could leave a reader afraid to vote in person on Nov. 3.

So read the record in the order it protects you. A law has stood since 1865. The Pentagon put it in writing this week. Your county runs your polling place, and many states let you vote early. The fear only works if you stay home.

They boarded the ships at night. Masked and disguised, they broke into the cargo and dumped about $1.7 million worth into the harbor. Private property, all of it. This all happened right after a massive protest. Now the protest leaders deny any part in it. They blame outside agitators. Sound familiar?

Stop there.

What did you call them?

Rioters! Vandals! Criminals! Domestic terrorists! Maybe a name you have been saving for the other side for a few years now. Or maybe you felt a small warmth, because you guessed whose side they were on and you liked the side. Either way, you had a verdict before you had a date.

The date was December 16, 1773. The city was Boston. The property belonged to the East India Company, and the cargo was tea. Most of us learned to call those men patriots and the night a party.

Every fact in that first paragraph holds up. The ships, the night, and the protest are in the standard record: thousands packed the Old South Meeting House that day. The $1.7 million is the Census Bureau’s estimate of that cargo in today’s money. The soot they used for masks, the disguises, and the blame on outsiders come from the historian Alfred F. Young. “Outside agitators” is today’s phrase for what those leaders said. I changed the vocabulary and the tense. Nothing else.

Repair protocol: when a word fires you before the facts arrive

Name your word first. Before you read on, say the word you just used for them. You cannot check a reaction you have not noticed.
Find the date, the place, and the people. If you cannot name all three, you are holding a label, and a label is not a verdict yet.
Split the cause from the conduct. Washington supported Boston’s cause and still judged the destruction of the tea. You can do both in one sentence.
Ask who named it, and when. Names often arrive after the event, from whoever won the argument about it.
Swap the words and read it again. Describe it in the other side’s vocabulary. If your verdict flips with the words, the words were deciding.
Say what it points to without the word. If you cannot describe the act without the label, the label is doing your thinking.

Name the standing rule. Pick an institution you have skin in. Your kid’s school district, your union local, your city council, the Fed you retired from, the museum you volunteer at. Find the one sentence in its charter or its published mission that says what it exists to do. Write it down.

Find the memo that changed it. Look for a recent policy update, a board resolution, a new “standards” document, or a letter from an executive above the institution. Read for the one sentence that appears to correct or reframe the standing rule.

Ask who signed the memo. Not who announced it. Who signed the piece of paper. If the paper is unsigned, that is a fact about the mechanism.

Landing

Four institutions this week. One judge, one Republican congressman, one Fed chair, one Interior Secretary. Four charters — the Kennedy Center statute (1958), the standing right of Congress to declare war (Constitution, Article I, Section 8), the Federal Reserve Act (1913), the Smithsonian charter (Act of Congress, 1846). The oldest of the four is the museum. The newest is 1958.

Three of the four had their rules met on September 15 or September 16. Cooper read the statute back to the White House and enjoined the memorial. Massie read the impeachment articles into the record and left the vote for his party to duck. Warsh voted unanimously with a Fed board Trump has been reshaping for eight months. The reading was public in each case. The paper is in each case.

The fourth had the rule rewritten. Burgum’s letter changes what the National Museum of American History is by directing the signs in front of it to say something the museum’s own leadership did not write. That is what makes it the outlier in the week. The other three institutions were told to bend. This one had its charter re-read from outside the door.

I want to name what all four have in common. They are the institutions the founders and the Congresses that came after them built to check the executive. Article III courts. The impeachment power. An independent central bank. A public trust for the national memory. Every one of them was designed to hold when the person in the top office wants a different answer than the record produces. Every one of them held or is being tested this week.

The pattern is that four institutions were tested inside 48 hours, and the news reported them separately because that is how the beat is organized. Read them together and the week has a shape. That shape is what a Friday Binding is for.

I refuse to know one story a day. The record produces four at a time. I refuse to forget any of them.

Flextiger, writing on September 17, argues the Fed’s quarter-point hike is not an institution holding against the President. It is coordination. Warsh built credibility with the hike so he can deliver larger cuts in 2027 when AI-driven deleveraging hits employment. Trump’s public demand for one percent, in that read, is a signal aimed at trade partners, not at the Fed itself.

I am not sure Flextiger is right. The unanimous vote, the timing, and Warsh’s own statement that the Fed “cannot affect any individual price, whether it be oil prices, or foodstuffs” all read to me as an institution defending its ground.

I include the piece because “the institution held” is the reading I want most, and the reading I want most is the one I have to check hardest. Read Flextiger against HCR. If the hike is coordination, the pattern in this Binding is stronger than I claimed, not weaker. Three institutions holding lets one get rewritten with less notice.

Author's note. I posted this on Facebook on September 8, 2026. The thread ran 544 comments in the first fifteen hours. As I close this essay on September 11, it sits at 571. I read every comment. Every commenter is anonymous in what follows. The pattern is what I brought to the piece.

In March 2025, Joe Kasper, chief of staff to the Secretary of Defense, prepared a card. Six facts, drawn from the personnel record of General Chris Donahue, the officer his boss was about to remove. Each fact answered a charge that had been floated against Donahue. Kasper handed the card to the Secretary in a car ride. The Secretary looked at the card. He looked at Kasper. He said three words.

“I don’t care.”

The New York Times filled in the car ride on September 8, 2026. I had published the underlying argument on this Substack ten weeks earlier, on June 24. I did not know then about the car, or the card, or the reply. What I knew was what warrior ethos means. The piece was called “What Do You Mean by Warrior Ethos?” It examined the space between what the Secretary said his standard was and what his standard actually was. The removal of a four-star general who had commanded the perimeter at the Kabul airport made that space visible.

The Facebook thread went to work on Donahue too. He was called a careerist. A Milley protégé. A political general. A DEI project. None of the labels touched what the record says he did on the ground for over twenty years. All of them tried to make the removal about the general’s character instead of the Secretary’s.

The car and the card are the receipts.

The two standards

Leaders listen to the argument. Pseudo-leadership avoids it, calls it names, discredits it. The concept comes from Bernard Bass and Paul Steidlmeier’s 1999 study of transformational leadership, which named the pattern: the trappings of authority used to serve the leader rather than the office, dissent suppressed rather than answered. The Secretary’s three words are a specimen.

Let me say what this essay is and what it is not.

It is not a claim about the Secretary’s legal authority to remove senior officers. He has it. Civilian control is bedrock. Every Marine and every soldier is trained on why. I am not arguing the authority.

I am arguing the ethic under the authority.

My claim is narrow. The Secretary publicly named warrior ethos as his own standard. The ethic he applied in the car, six exculpating facts answered with three dismissive words, is not warrior ethos. It is what a warrior ethos was built to prevent.

That is the argument. And it is what a public can hold to account.

Joe Kasper did what a chief of staff is supposed to do. He prepared the correction. He delivered it. When the correction stopped at “I don’t care,” the case moved from the inside of the department to the outside. That is why publics like this one exist.

By “public,” I mean what Hannah Arendt named in The Human Condition (1958). Not an audience. Not consumers. Not a demographic. A public is the space where citizens appear to one another and make meaning together in view of the record. When Kasper’s correction stopped at “I don’t care,” the case moved into that space. What a public does with a record is what a republic is.

The frame we forgot we were running on

Samuel Huntington’s The Soldier and the State, published in 1957, framed American civil-military relations around a specific bargain. Huntington called it objective civilian control. A professional military serves whichever civilian leadership the electorate hands it. In exchange, the military stays politically neutral as a body. The professional military does not owe the president personal loyalty. It owes the office competent service and the law obedience. That is the standard we have run on, formally, since Goldwater-Nichols in 1986.

Huntington named the failure mode. He called it subjective control. In subjective control, civilian leaders demand personal loyalty from senior officers as the price of continued command. When that demand becomes the operating standard, the professional military is no longer serving the office. It is serving the person in the office.

The guardrails against subjective control are specific. Article 88 of the Uniform Code of Military Justice restricts what officers can say publicly about civilian leaders and protects the officer from being punished for lawful private counsel. Senate confirmation of senior officers is a check on the executive’s power to install loyalists. The conventions of the Joint Chiefs are the operating protocol: dissent in private, execute in public. Together they are the fence Huntington told us we would need.

When those guardrails go, we are inside the failure mode we were told to design against.

Senator Joni Ernst is a Republican from Iowa who sits on the Senate Armed Services Committee and retired from the Iowa Army National Guard as a Lieutenant Colonel. General Donahue asked her whether the Secretary would work with him if he took the Army chief of staff job. Her answer, on the record, was “Honestly, no.”

That is a guardrail speaking in the voice it was built in.

What the thread did with the record

I posted a Facebook version of the June essay on September 8, 2026. Five hundred forty-four comments in fifteen hours. I read every reply. When the volume outpaced my ability to reply, I decided to code the pattern.

What follows is a description of what came at a documented case when it met a public. I have not named a single commenter. The pattern is the point.

The gates. “No tab Pete.” “You never held the positions you describe.” A gate is a way to disqualify the speaker without touching the argument. One commenter said a critic of a Secretary of War should have a Ranger tab. I am a Marine. I do not know much about the Ranger tab. What I know is what the record says.

The whatabouts. Past Secretaries of Defense. Milley. Austin. Biden. Obama. DEI. Afghanistan. A specific critique of the current case was met, over and over, with a demand to litigate a different case first. This was the single most common deflection across the thread. The audit was proposed as a substitute for the record. The substitution changes the subject. That is what it is for.

The cascades. The claim that Trump’s Doha agreement forced the release of 5,000 Taliban prisoners and produced Abbey Gate. The claim that a Toyota gun-truck belonging to the enemy was flown out on a C-17 while Americans were abandoned on the ground. The claim that someone other than General Donahue was the true last U.S. service member off the tarmac at Kabul. Each is false or badly distorted. Each arrived in the thread from multiple commenters in near-identical wording. Task & Purpose reported the truck story out of the record. The last person off the tarmac was General Donahue, on August 30, 2021, at 11:59 PM. When a public prefers a meme to a fact that a five-minute search returns, the failure is not just the meme’s.

The frame swaps. “Careerist.” “TDS.” “Paralysis by analysis.” Each of these takes the argument about the Secretary’s stated standard and replaces it with an argument about the writer’s motives, the reader’s politics, or the general’s temperament. Each is a way of not reading the record.

The loyalty ceiling. Some commenters argued, quietly and often thoughtfully, that a public cannot judge the removal because it lacks classified context. This is real epistemic caution. It is also a way to close the public case entirely. The public case is public. The car ride is public. Kasper’s card is public. Ernst’s “Honestly, no.” is public. Reading what is public is what publics do.

The public we are

Every strategy above is a version of the Secretary’s reply. Avoid the argument. Call it names. Discredit the source. The aggregate of the thread mirrored the aggregate of the car ride. Pseudo-leadership is contagious. A public that runs the same three plays becomes the mirror the leader deserves, or perhaps wants.

The aggregate is not everyone. Some veterans on the thread tested the frame carefully. Some retired NCOs pushed back with substance. Some officers ran the coding argument hard. A Ranger who pushed on DEI as the real mechanism engaged the argument on its merits. Two commenters — one with a Public Ethics loyalty frame, one a 36-year Army officer — ran fourteen turns of real democratic exchange in a subthread before the meme wave rolled over it. That is what a public reading carefully looks like, when it happens.

The aggregate pattern was different. When a public was shown a documented case, the most common counter redirected to a different case. Or ran a gate. Or delivered a meme. Or swapped the frame.

The failure is bigger than the Secretary. What the thread showed was Richard Dawkins’ work operating in real time on a Facebook feed. In The Selfish Gene, Dawkins coined meme to describe a unit of culture that propagates by imitation and lives or dies by how well it copies. The Doha claim, the truck claim, and the last-person-off claim are memes in that original sense. They arrived from multiple commenters in near-identical wording because they copy well. When enough of us pass a meme forward without opening the record it replaces, the meme becomes the story. Democrats did it. Republicans did it. Independents did it. Veterans and non-veterans did it. The finding is civic. Culture is what we let replicate.

What I remember about the day

I remember the day the standard we are now abandoning was being written.

September 11, 2001. Staff Sergeant. Marine Officer Selection Assistant, University of Texas at Austin. Twenty-seven years old, eight years into a career that would run fifteen more. I was on my way to campus when the first plane hit the North Tower. By the time I reached the food court above my office, the second one had gone in. I stood there in uniform. People looked at me. I remember thinking, in the plainest words I had: what is going on.

I did not know then that the twenty-year war ahead would be run on the ethos being written that hour. I did not know I would be in Anbar Province by early 2003, and back again by the end of that year. That Anbar would take me again in 2008 with MNF-WEST. That Helmand would take me in 2011 and again in 2013. That a general who walked off the tarmac at Kabul as the last U.S. service member out in the summer of 2021, in a country I had walked, would have his record pulled into a car in March 2025 so a Secretary of War could answer six exculpating facts with three words.

None of us knew.

What we know now is what the record says. The standard we built in the years after that food court is being answered, at the top of the department that carries our name, with a reply we do not accept from a private on his first day.

I woke up to news that another Black man was found hanging from a tree in Raleigh, North Carolina with local police calling it a suicide the same day. It feels like we are waking up to another lynching in another city across the American South over and over again: Javion Magee, Dennoriss Richardson, Earl Smith, Demartravion Reed, Kyle Bassinga, Juliana Nzita, To’Nea Nicole Miller, Jerard Jackson. It is something I did not think I would witness in my lifetime; I didn’t think twenty years ago that our country still had the capacity for this. After all we learned from the civil rights movement, the progress proved false, merely a superficial calm, an illusion of growth, and the suppression of dissenting voices. So here we are. Ida B. Wells’ spirit is weeping. Sad, disappointed, but not surprised. She stands alongside our ancestors and elders who knew that the capacity for violence never truly left our land.

The same reason racist white people have become emboldened is the same reason why the very power we need to investigate these hate crimes, our federal government, will do nothing about them. The Trump administration is rooted in white supremacy, and any civil rights protections Black people once had have now been redirected to support the whims of a white racist populace. That sort of rewrite of history is evident in the clemency granted for 1,500 January 6th defendants or lawsuits by the Equal Employment Opportunity Commission accusing employment reverse discrimination against white men. The current administration certainly learned from the civil rights movement, understanding how the federal government intervened in states’ reign of terror during the 1960s. Think of the picture of Ruby Bridges being marched into class flanked by U.S. Marshals.

This is not lost on the people committing these crimes. They know that no one, neither their local racist governance nor the federal government, is coming to look for them. They also know their time is limited: do it now before the administration changes. They hope that any trace of their involvement will vanish by the time someone in official power gets around to investigating. We all know from the famous television show that the first 48 hours are essential to solving a murder. Those hours have come and long gone for each of these precious lives. The best evidence we have at the moment is the assertion by Black voices throughout this country from actors like Viola Davis, influencers like Deanté Kyle to academics like Dr. Stacey Patton and Dr. Michael H. Forde: Black people do not hang themselves from trees. The Equal Justice Initiative says over 4,400 race-based lynchings occurred in the United States between 1877 and 1950; 4,075 happened in Southern states. This is not lost on Black people. The reality is clear, but speaking out feels like screaming into a social media void that only echoes our own voices back to us.

This sense of dread brings me emotionally back to the days before Trump was elected. It became clear to me then that my more leftist friends had decided, out of moral conviction, that they could not vote for Kamala Harris. The lack of action to protect the people of Palestine meant she was not worthy of their vote; it was simply more of the same. What’s the difference? We need revolution. Let the empire fall.

I agree with these assertions in theory. I am angry and heartbroken at the genocide occurring to this day, especially the way the United States looked away during October of 2023. The United States vetoed multiple UN resolutions for cease-fire. In December of the same year, the Biden administration pumped more money into Israel, even bypassing Congress for emergency arms sales. We need accountability. There must be action. The plantation-capitalist system will never serve everyone fairly and must be dismantled for true equity to exist. Big money in elections has corrupted our politics, and so many candidates are bought and sold by the wealthy few under the lie that they act on behalf of “corporations made up of the people.” I know all these things to be true.

Yet right before the 2024 election, a heavy grief settled over me, a grief that felt ancient and modern at the same time, that bridged the years between 1619 and that day. I realized that the impossible was possible again: Trump could win. My anger at my leftist friends softened into pure hurt and grief, finally reaching the primary emotion beneath the anger. I no longer needed to be angry with them for following their conscience. How do you vote for a politician with blood on their hands, even against a more bloodthirsty opponent? We are all exhausted from choosing the lesser of evils.

But here is what I knew, what that feeling of grief felt in my bones told me: a Trump victory is not just “more of the same.” The evil of white supremacy has already been unmasked. Now it will empower more bad actors to act out their whims wherever conservative governments hold power. And I knew that the sacrifice placed on the altar of a clean conscience would be Black bodies. That has been the bargain in the United States over and over again. At the very founding of this country, men who knew slavery was wrong decided that unifying the new nation was the higher goal. A nation built out of anger of having to pay taxes on stolen land and calling it tyranny. You can go back to the writing of the Declaration of Independence, when Thomas Jefferson was ordered to take out the clause on the evils of slavery. The Three-Fifths Compromise gave enslavers more political power robbed from the enslaved. The fugitive slave laws made it illegal to help an enslaved person on free land — your conscience did not outweigh the property rights of white men. The Scottsboro Boys, accused of a crime they didn’t commit, were thrown to the angry mobs to assuage their hunger for vindication and white domination of the races. The lynchings, too numerous to list out individually on this page. Black bodies were the original sacrifice in America, and they remain so today.

I do not want to overlook how Brown bodies are placed on that same altar, as ICE raids continue to wreak havoc and people suffer and die in detention centers. The ACLU reports that deaths occur at a rate of roughly one every six days in ICE detention centers. But this reality exists because our foundational system was built upon the subjugation of enslaved Africans, creating a permanent ruling class designed to expand political power and feed the moneymaking machine.

The sadness and dread I feel centers on the realization that whether we are on the road to a people’s revolution or the collapse of an empire, the outcome remains rigged. Because our entire political systems were built directly over the fault lines of the original slave states versus free states, those red areas on the map do not merely represent the modern-day GOP. The well-documented Southern Strategy was written about as early as 1969 by Kevin Phillips, explaining how the Republican party would emerge over the following decades. From George Wallace saying in 1958 after a defeat for Alabama governor, “I was out-niggered by John Patterson, and I will never be out-niggered again”, to the congressional defection of Strom Thurmond from Democrat to Republican directly after the 1964 Civil Rights Act was passed. That red on our political maps represents the Black blood that continues to be spilled — and will continue to be spilled — as the bloodthirsty false god of white supremacy, like the biblical Baal, accepts its offerings unfettered and unbothered. The link between politicians using white animosity toward Black bodies for political gain is crystal clear.

For myself, as a Black person who grew up on Dynamite Hill in Birmingham, Alabama, who knows the four little girls killed in the Sixteenth Street Baptist Church bombing as friends of my older siblings and neighbors of my parents, who has been in the homes that were bombed, I know first-hand the sacrifices of apathy. If we are to change things, we have to vote and use the political system we have until we can get power to change it fundamentally. The goal must be as strategic as the ones used to disenfranchise us. Staying home on election day is not an option for me. The choice between Harris and Trump would not have brought revolution, but it would have saved actual lives as we fight to create more substantive change. The life taken could be your friend or neighbor instead of a distant video on your social feed. I hope we all remember that this fall and in 2028.

This piece is not written to indict the political left. I count myself among that number. What often looks like disaffection is not apathy; I know too many people who care deeply and carry profound distress. Rather, it is an appeal to readers of every persuasion to recognize that political and social reality is rarely binary. The road toward justice and healing is neither straight nor gentle, but an imperfect vehicle is no reason to abandon the journey entirely. If we are to preserve any actionable hope within an embattled system, we must commit to relentless, strategic participation—thinking two steps ahead rather than reacting purely from the moment. The Name They Keep Reaching For

A friend posted a meme on Facebook:

Obama didn’t have time to rename lakes, he was busy working to get Americans healthcare.

Six words showed up in the first comment.

He had time to rename a mountain tho.

That comment has one job. Occupy the space where fact-checking would sit, long enough for a scroller to see a “debate.”

Here is the record on the mountain. Alaska petitioned to rename McKinley in 1975. Ohio blocked the petition for forty years. In 2015, Interior Secretary Sally Jewell moved it under 43 U.S.C. § 364, on federal land, at the state’s request, through the same Board on Geographic Names statute that resolves this kind of naming dispute every year. One rename in eight years. At a state’s request. Through statute.

Since January 2025: Denali reversed by executive order. Gulf of Mexico renamed. Seven Army bases renamed back to their Confederate namings. The Defense Department renamed to the Department of War. Lake Ontario renamed Lake America. The president has floated an ocean too.

One rename at request through statute is not the shape of a serial pattern by assertion. The comparison the six-word comment invites collapses on the second click. It was not built to survive the second click. It was built to sit there.

Before I get to my own thread

Here is what I felt when I saw the comment.

Recognition. I have watched this shape work on people I love for years. Marines I served with. Family members. Students. None of them are gullible. The instrument is built to reach past the parts of us that check. Our bias.

You see the six words go by and you know the friend who commented is not going to Google Denali. You know the friend who posted the meme is going to read the comment and feel the ground shift a little. Facts are heavy. Comparisons are light. The comment is designed to be lighter than the thing it wants to displace.

That is the feeling. Recognition, and the quiet knowledge of what comes next. In the Corps, when the same shape keeps working, you give it a name, a rule of thumb. You teach the next Marine to see it. You write it down.

The same shape, one thread over

Two days later, a comment landed on my own Facebook post. Different subject, same shape:

Obama FIRED 197 officers, all the way down to O-4s, same pattern, all male, all conservative, all non-woke, all republicans.

I asked for a source. What came back was “There’s this thing called Google...” I chuckled. A different commenter jumped in: “are you too stupid to refute it yourself with intelligence.” I chuckled again. A third: “every president removes commanders.” I laughed out loud…not like this!

Three variants of one motive. None defended the specific claim. All did the same work as the mountain comment. Occupy the space where the current record would go.

Where 197 comes from

The number traces to a 2013 Breitbart Facebook post. Retired Major General Paul Vallely — a birther who told a Tea Party group in January 2014 that if given 250,000 Marines he would “surround the White House” — reposted the list on his Stand Up America site. An unsigned Investor’s Business Daily editorial published it on October 29, 2013, and updated the same file on December 21, 2018.

Every case IBD names as evidence of a purge is an individual misconduct dismissal. General Carter Ham retired through routine command succession; Chairman Dempsey called Benghazi speculation about that departure “absolutely false” and DoD called the rumors “categorically false”. Vice Admiral Tim Giardina was removed for gambling with counterfeit poker chips. Major General Michael Carey for public drunkenness on a trip to Moscow. Rear Admiral Chuck Gaouette for “inappropriate leadership judgment.” Not one is a policy firing. Jim LaPorta, the national security journalist who covers this beat, put it plainly: the 197 list combines years, includes field-grade officers, and covers “sexual misconduct, DUIs, leadership issues” — matters no president would weigh in on.

The New York Times called the 197 number “no basis in fact”. Pentagon spokesman Sean Parnell used it in a November 2025 statement to the Times; press secretary Kingsley Wilson then asked the Times not to publish that language and sent a replacement statement that omitted the number entirely. Six months later, Secretary of Defense Pete Hegseth said it under oath at the House Armed Services Committee on April 29, 2026.

That is not a mistake repeated. That is a piece of coordination tested for thirteen years, deployed at the moment it was needed.

One commenter’s stronger version

A different commenter on my thread offered a sharper argument. He pointed to Christian II v. United States (Federal Circuit, 2003) and Judge Royce Lamberth’s 2015 Saunders ruling. Both are real cases. Both found that Army selection board instructions from the 1990s created race and gender preferences the courts held unconstitutional. He gets the direction right. Federal courts did strike down specific Clinton-era mechanisms.

Two things his framing misses. The rulings targeted board instructions on how to weigh officers’ records where past discrimination appeared. They did not describe “aggressive affirmative action metrics” driving dismissals. And the Saunders ruling came down in January 2015, under President Obama, six years into the term the meme now calls a purge.

Author's note. I held this piece back for a week. Jason Arday was a Black professor at Cambridge, appointed young, praised by his institution before his institution stopped defending him. I am a Black educator and public writer publishing under my own name. The mechanism that closed on him is the mechanism I write from. I did not want to draft this while I was still angry. I did not want to draft it while I was still struggling to understand. There is so much more to this story than one essay can hold. This is the one I could write honestly this week. — JWW

On August 14, 2026, at 1:01 in the morning, the Daily Mail published a column by a psychiatrist who had never met Jason Arday. The headline promised to name the “one condition that could explain everything” about him. Inside the piece, the author admitted: “I’ve never met Jason Arday, and so have no idea what has been going on in his mind.” The column is still live on the Mail’s website.

At 3:11 that afternoon, The Telegraph published its next article about Arday. Ambulance service records show a call to his south London address one minute later. He was 41. Metropolitan Police called the death unexpected but not suspicious. The coroner’s file remains open.

Between his August 5 resignation from Cambridge and his death nine days later, 188 articles about him appeared across 15 outlets.

I am not writing this piece as a philosopher. I am not a sociologist of education. I am a Marine Corps veteran with 23 years in an institution that teaches you not to fire until you have identified your target, your rules of engagement, and the terrain. I hold a doctorate in Organizational Change and Leadership from USC Rossier. I teach at UC Irvine. I publish a Substack about how institutions fail the publics they owe. That is where I stand. It is where I write from.

What is settled

The plagiarism findings against Jason Arday are real. This is not the piece where I hedge that.

The Telegraph commissioned an independent statistical analysis of Arday’s 2015 dissertation against Paula Zwozdiak-Myers’s 2009 Brunel dissertation. The analysis found 188 matching sentences and more than 100 identical or near-identical passages. The statisticians put the odds of that overlap arising by chance at one in 100 billion. David Sanders, the Purdue biochemist who conducts this kind of work professionally, reviewed the 63-page dossier and said there is no question extensive plagiarism occurred. Further overlaps surfaced with a 2013 Texas A&M paper and a 2007 paper by Aderibigbe, Colucci-Gray, and Gray.

The more serious allegation involves interview quotations Arday attributed to his own research subjects appearing nearly identical to quotes in Anjum Memon’s published work. If that finding holds, it is fabricated data. That sits in a different category from plagiarism.

Some of Arday’s biographical claims did not survive scrutiny. His memoir bio said he had raised between £4.5 and £5.5 million for charity. The surviving 2010 JustGiving page shows £6,285. Simon & Schuster stripped the financial claims from the bio before publication. Glasgow and Ohio State both denied he held the ongoing visiting appointments he had listed. Asked why he had documented none of it, he reportedly said: “I thought you’d just believe me. Why would I lie?”

I write these things down because the piece that follows only works if the plagiarism is on the table. Take it off, and the piece becomes a defense of the man rather than an audit of the institution. That is not the piece I am writing.

What else is settled

On March 6, 2023, Cambridge announced Jason Arday’s appointment as Professor of Sociology of Education at the age of 37, the youngest Black professor in the university’s history. Cambridge also published his life story: the nonverbal childhood, the late literacy, the marathon fundraising, the Olympic torch. The university verified none of it.

In May 2023, retired academic Dave Harris wrote to Arday about similarities between a 2018 article in Social Sciences and other published work. Arday called it bullying. Sociologist Martyn Hammersley reviewed the article and documented substantial plagiarism and unattributed quotations. Cambridge declined to investigate, citing that the work predated Arday’s appointment.

In September 2025, Times Higher Education reporter Jack Grove had a finished story with 97 pages of evidence he had submitted to Cambridge and Liverpool John Moores. Arday retained the defamation firm Carter-Ruck. THE killed the piece. Arday filed a complaint with the Metropolitan Police against Grove. The Met investigated the reporter for four months. Sir Mark Rowley, the Metropolitan Police Commissioner, later admitted the force “dropped the ball” and “should not have investigated.”

In July 2026, Nathan Cofnas published the plagiarism allegations on Substack. Cofnas is a philosopher pushed out of his own Cambridge fellowship for defending hereditarian race science. His involvement is a fact readers should know. It does not falsify the document match, which was subsequently verified by The Telegraph’s independent statisticians and by David Sanders.

On August 5, 2026, Arday resigned. On August 12, Cambridge Vice-Chancellor Deborah Prentice announced an independent investigation into his appointment. She called the case “an aberration” and said it “should not be used to cast aspersions” on staff of colour. Ten years ago, George Yancy wrote something

In December 2015, philosopher George Yancy published a piece in The New York Times called “Dear White America.” He asked white readers to sit with their complicity in a racial order they had not chosen but from which they benefited. Within days, his university email filled with racist hate mail. One letter opened “Dear Nigger Professor.” A voicemail told him he would be “beheaded ISIS style.” Another message ended with “Be Prepared.”

Four months later, Yancy wrote a follow-up called “The Perils of Being a Black Philosopher.” Here is what he said the messages did to his body:

“The comments were not about pointing out fallacies in my position, but were designed to violate, to leave me psychologically broken and physically distraught. Only now have I really begun to recognize how discourse designed to hurt can actually leave its mark. I recall after reading so many of these messages I began to feel sick, literally. So, words can debilitate, violate, injure; they can hit with the force of a stick or a stone and leave marks on the body.”

And then this:

“There were some very nasty remarks that were designed to question my status as a philosopher because I’m black. The implication of those messages was that to be black and a philosopher was a contradiction.”

Yancy is 65. He teaches at Emory. He survived. What kept him alive was the response of his profession. The American Philosophical Association issued a formal statement condemning the harassment. Colleagues traded experiences with him. His wife, four sons, and his university, whatever their failures, moved to defend him rather than open a file on his qualifications.

Jason Arday had none of that when the machinery came for him.

The mechanism Yancy named a decade ago is what killed a man in Battersea on August 14. It is not the only mechanism at work in the Arday case. It is not the only fact. I am not honest if I do not name it.

What Yancy makes visible in this case

Yancy would not defend the plagiarism. Read the long interview published in What Is It Like to Be a Philosopher, and you find a man whose entire identity as a scholar rests on the demand for standards. He came out of the Richard Allen Homes in North Philadelphia reading Bertrand Russell at 17. He does not soften the requirement of rigor for anyone.

What Yancy would name, and what the American press covering this story has largely refused to name, is that the same demand for rigor operates unequally by race.

Stacey Patton, professor at Howard University, called it “the digital lynching of Jason Arday.” Karen Attiah, formerly of the Washington Post, called it “digital racial terror,” a form of deterrent messaging aimed at other Black professionals. Kate Manne, the Cornell philosopher, wrote that “gossipy academics helped kill Jason Arday” and refused to debate the plagiarism because the plagiarism was not the point of her piece. Tahir Abbas, professor at Leiden University, wrote that “a man turned into an argument” while “two institutions” sheltered behind him. Paul Tiyambe Zeleza wrote that Arday was killed by many people and institutions rather than one.

These are not defenders of academic misconduct. They are scholars naming what happens to Black academics who are elevated for symbolic reasons by institutions that never bothered to check the elevation, and then abandoned by those same institutions the moment scrutiny arrives.

The pattern is documented. When Claudine Gay resigned from Harvard in January 2024 after plagiarism allegations, Harvard’s own review found the allegations did not meet its misconduct standard. Six of the seven prominent post-Gay plagiarism targets in American academia were Black. All four Harvard targets were Black women. Dan Ariely retained tenure at Duke. Neri Oxman left MIT on her own terms in 2024. Francesca Gino had her tenure revoked by Harvard in May 2025 — the first Harvard tenure revocation in about 80 years — after roughly two years of contested legal process, and she is currently suing Harvard for sex-based discrimination. An unnamed white Cambridge professor documented in Bhabani Nayak’s August 2026 analysis copied undergraduate work, was found in violation by a university tribunal, and was later promoted to associate professor. The tribunal called the plagiarism “the product of negligent acts but was not deliberate.”

The claim I am making is not that Black academics plagiarize less or more than white academics. No dataset measures that. What I am claiming is about what happens after. When white academics are found to have plagiarized, the modal outcome is that they keep their jobs. When Black academics are accused of plagiarism, the modal outcome is investigation, resignation, and in the two cases I will name in this piece, death.

Bonnie Candia-Bailey, Vice President for Student Affairs at Lincoln University of Missouri, died by suicide on January 8, 2024, the same day she emailed her president alleging months of harassment, bullying, and racial discrimination. An internal board cleared him. Between her death and Arday’s: 31 months.

A note on white philosophers

There is no essay called “The Perils of Being a White Philosopher.” That literature does not exist.

Charles Mills, the late political philosopher, spent his career explaining why. Philosophy operates within what he called a “view from nowhere” that actually represents white particularity presented as universal truth. White experience becomes so normalized as the standard perspective that its racial specificity disappears from view. What Cambridge owed

I run a research practice that studies how institutions fail the publics they owe. The framework I work with has a plain question at its center. When a divergence between what an institution has published and what is actually the case is detected, does the institution surface it and repair, or does it suppress and defend?

Cambridge suppressed and defended for 39 months.

The university published a life story it had not verified. The university declined to investigate scholarly complaints on the ground that the work predated the appointment, a ground that made sense only if the appointment itself had required no scholarly review of the work. The university’s press office continued to defend Arday publicly through June 2026. The Times Higher Education story that would have surfaced the complaints in September 2025 was killed after Carter-Ruck engaged. The reporter who tried to ask questions was investigated by the Metropolitan Police for four months. The Met Commissioner later said the force should not have investigated him.

When Cambridge finally opened its investigation on August 12, 2026, the university was not repairing. The university was ratifying a verification other people had already performed. That is not accountability. That is what an institution does when it has run out of ways to defend its earlier decision.

What the family said

Arday’s family, through Simon & Schuster UK, released a single statement:

“Jason was subjected to a campaign of sustained abuse for more than three years since he accepted the role of professor at Cambridge University by those who would leave no stone unturned in their quest to undermine him. The campaign of misinformation was too much for Jason, who was a gentle man and who always wanted to see the best in everyone. We are in shock to have lost this amazing father, partner, brother, uncle and son. We won’t comment further at this point beyond asking the press to leave us alone now, and to stop the campaign of harassment which has been waged against Jason and his family for too long.”

I do not translate this statement. It is the only authorized account of what the last three years did to him. It is a family’s public word. Read it, and sit with it.

What I am not saying

I am not saying the plagiarism was invented. It was not.

I am not saying racial hatred killed Jason Arday. The coroner has not ruled. The family’s framing points one way, the Change.org petition asking for an independent review of the death circumstances points another, and I will not put words in a coroner’s mouth or a family’s mouth. That question is not knowable from the record as it stands.

I am not saying Cambridge’s critics were all acting in bad faith. Some were. The document match still holds. Nathan Cofnas has publicly defended race science. That fact does not falsify the plagiarism findings. Both things can be true, and both are true. The proper response is to notice both.

I am not saying Black academics should be exempt from scrutiny. The opposite. I am saying that scrutiny, when it is real, applies equally.

What I am saying

I write publicly under my own name. I have an employer, an institution, subscribers, a family, and a reputation. Every one of those exposes me to the same machinery that ran across Jason Arday for three years and closed on him in nine days.

The question this case leaves for anyone who writes publicly under an institution’s name is not whether a search would find something. Everyone who has ever written has something a search could find. The question is who would be entitled to conduct the search. Whose complaint would open a file. Whose story would run. Whose complaint would be dismissed as vexatious. Whose lawyer would be called first. Whose university would open an investigation into the questioner rather than the question.

Cambridge published a life in 2023 and started checking it in 2026. In the years between, the people who tried to check it were reported to the police, sued into silence, or ignored. The people who defended the unverified claims were treated as the ordinary voice of the institution. When the outside pressure grew large enough to force a change, the institution announced an investigation and called the case an aberration.

Two days later, a man was dead.

On Wednesday, I published a Field Guide about a leaked memo that told House Republicans to merge three words. Then I went to my own comment section.

I wrote that China is run by a communist party, that North Korea dropped communism from its constitution in 2009 and runs on Juche, and that Russia has not been communist since 1991. Three countries, three answers, one word. I wrote it because a reader had merged all three, and I said that if we ask the other side to name which meaning they mean, we do it too.

One of the readers I had just corrected replied with six words.

“I was lazy and will be better.”

I learned a long time ago to say that sentence out loud, in front of the people you got it wrong in front of. It is not comfortable, and it is not supposed to be. It is how you correct a record and stay accurate.

I have been reading political writing for a long time. I cannot remember the last time I saw a professional writer say that sentence about their own work.

So I went looking. Over the past few days, I pulled and read 76 published pieces on the fascist and communist labels, from Substack and adjacent outlets, across the political spectrum. I did not try to grade whether the writers were right. I was grading one thing: does the piece give you anything you can check?

Primary documents. Named scholarship. Data with a pollster and field dates. Reporting you can follow to its source. Or nothing.

The pattern that came back shocked me, and the party lines have nothing to do with it.

The thread, in one day

Before the writers, the readers. My Wednesday comment section ran the full range of evidentiary behavior in about twelve hours.

One commenter wrote that communism, socialism, Marxism, and fascism are all the same, and that any difference is cosmetic. That is the merge, performed live, in a thread about a memo instructing the merge.

Another commenter disagreed with him and provided definitions, drawing the line between key and all means of production. Then she said the memo was no big deal.

A third commenter, Rick Tilson, tested her definition against 1984 and asked whether Orwell’s state was therefore communist.

A fourth arrived with a careful, qualified historical argument about twentieth-century death tolls, and when I answered it, came back with nine names and the number 100 million.

And a fifth wrote his six words.

Five readers. Merge, correction, stress test, escalation, self-correction. None of us were paid. Nobody had an editor.

Hold that against what follows.

Finding one: the best evidence and the biggest word rarely appear together

Start with the writers whose work I could check.

Judd Legum built a documentary record of who is financing immigration detention: a $450 million revolving credit line from Citizens to GEO Group; a $500 million CoreCivic bond underwriting; an AT&T contract with a dollar figure and a date; and detention population figures from January 2025 forward. Every number traceable. He does not use the word fascism. He does not use the word authoritarian. He builds the record and lets you connect the dots.

Radley Balko quotes the Minnesota Attorney General’s federal complaint, a DHS memo on warrantless home entries, and Judge Jeffrey Bryan’s Fourth Amendment ruling verbatim. The word appears once, as an adjective, buried inside the filings.

Joyce Vance is a former United States Attorney. She writes about a nine-to-nothing Supreme Court ruling, a Justice Department indictment, and Kevin Roberts on the record. Across the piece, she uses autocracy and autocrat. She never once writes fascism. A former federal prosecutor choosing the narrower word is not an accident.

Anne Applebaum rejects the label outright on conceptual grounds and offers a replacement: autocratic state capture.

Now the other column.

Will Stancil writes that Trump and Musk are openly breaking dozens of laws. He names none of them. The piece carries no links, no documents, no data.

Lucian Truscott IV states as fact that half a billion dollars from Venezuelan oil was deposited into a Qatari account. That is a specific, checkable, serious claim, and it is offered on his say-so.

Steve Schmidt published a piece whose entire argument is that we must call the thing by its name. The piece does not define the name.

Mike Brock concludes that Stephen Miller is a fascist. He paraphrases Miller throughout. He does not quote him once.

The same failure runs on the right. Matt Taibbi and Walter Kirn treat the fascism alarm as a recurring elite panic and support the claim with a podcast conversation about a single video. No data, no documents, no historians.

I want to be exact about what I am saying. I am not saying the well-sourced writers are right and the others are wrong. Legum may be too cautious. Stancil may be describing something real. I am saying that one column hands you the means to check it and the other asks you to just take it.

Finding two: four writers who set their own control group

Cross-writer comparisons invite the charge of cherry-picking. These do not, because in each case the control is the writer’s own prior work.

Timothy Snyder. In October 2024, he quotes Robert Paxton’s definition verbatim and cites Zeev Sternhell, Jason Stanley, and Tony Judt. I call that scholarship.

In February 2026, he argues that Trump is failing at fascism because fascism demands a major foreign war. Zero citations. In July 2026 he published a piece titled “What is Fascism?” that cites nobody in the body, listing two books afterward without engaging either. A piece with that title, from that author, that does not engage Paxton, Griffin, Payne, Eco, or Arendt?

In June 2026, he argues that a proposed military budget increase is a bribe to the officer corps. He cites the Guardian, the Times, another Substack, and four of his own prior posts. He does not cite the budget.

The standard fell as the publishing rate rose. I think that observation is extremely important.

Mike Brock. His August 3 piece on OpenAI quotes named executives directly and links TechCrunch, Fortune, the BBC, Reuters, NPR, and the Guardian. His piece calling a senior White House official a fascist quotes no one. Same writer, same month. He applies a higher evidentiary standard to a technology company than to the presidency.

Robert Reich. His close reading of the FCC-mandated CBS agreement is excellent work: he shows that the agreement never defines bias, never says whose complaints trigger action, never enumerates what other concerns mean. That is a writer reading a document. His piece asking whether Trump is a fascist answers in a word, yes, and cites no scholar of fascism at all.

Ruth Ben-Ghiat. Her essays carry named decisions, a Senate Finance Committee letter, House Oversight material, and the Solicitor General quoted from argument. Her conversation transcripts assert checkable claims about policy change with nothing behind them. The format changed. The standard changed with it.

Finding three: three things we need to do better

Nobody reads the memo. I audited twenty-four pieces arguing the communism fight. Not one engages the co/efficient document. It is the only artifact in this entire argument with a published sample size, field dates, and a margin of error. The people fighting about it have not opened it. I will keep my eye on it. Is the document a fake? A nothing burger?

Nobody engages the disagreement among scholars. Robert Paxton reversed his position in January 2021 and said the invasion of the Capitol removed his objection to the label. Almost every writer who wants the word cites that reversal. In the same 2024 interview in which he confirmed the definition fits, Paxton also said the word generates more heat than light and that he is not pushing it. Both halves are his. I found no Substack piece carrying the second half. But I could have missed it.

Worse: Roger Griffin defined generic fascism as palingenetic ultranationalism, the most-cited definition in the field, and he refuses to apply it to Trump. He told NPR in October 2024 there is no evidence of a coherent enough ideology, and he argues the danger is worse than fascism precisely because it can sit inside a democracy. Across all 76 pieces I read, I found zero engagement with Griffin. The single strongest objection to the label is absent from the conversation about the label.

Rutger Bregman is the one writer who argues the definition from the literature, citing Paxton’s Anatomy, the 1998 Journal of Modern History article, and Eco’s “Ur-Fascism” by venue. Even he does not carry Paxton’s hesitation.

Nobody answers the strongest version of the other side. Not a single defense piece addresses the atrocity argument on its merits. They answer the label or the motive. The hardest form of the charge goes unanswered.

Finding four: where the number lives now

Here is the finding that sent me back to my own comment section on Facebook.

The figure of 100 million deaths comes from The Black Book of Communism, published in 1997. Across twenty-four right-side pieces making the communism argument, that number appears exactly once, in a single August 2026 post, unqualified. Taibbi does not use it. Andrew Sullivan does not. Garry Kasparov does not. Rod Dreher does not. Christopher Rufo does not.

A commenter on my Wednesday post used it twice in eleven days.

The number has migrated. It left the writers and moved into the comment sections, and the argument about it did not travel along. Two of the book’s own contributing authors, Nicolas Werth and Jean-Louis Margolin, publicly broke with the editor over that aggregation in Le Monde in November 1997, at publication. Werth wrote the Soviet chapter that supplies most of the deaths. Neither the writers who use the figure nor those who answer it mention that.

This is what happens when a number outruns its sourcing. It arrives in a Facebook thread stripped of every qualification its own authors demanded, and the person repeating it has no way to know.

Finding five: the symmetry is real where you’d least expect, and false where it counts

I have to give ground here, because two writers did the work and their findings complicate what I would have said a week ago.

Chad Maschke audited 122,106 original congressional posts between January 26 and April 26 of this year, using a party-blind classifier with a second human validation pass. Democrats apply totalitarian-regime labels to Republicans at 0.055 per hundred posts. Republicans apply them to Democrats at 0.062. His conclusion, and I am quoting it because it is against my prior: the labeling is a tie. His argued asymmetry sits elsewhere, in eliminationist language rather than epithets.

Lindsey Cormack runs DCinbox, an archive of official congressional e-newsletters. Over roughly fifteen years, Republicans used “fascist” 53 times and Democrats 20. Her finding is that the accusation belongs to neither party. It surfaces when the opposition holds the White House.

So on frequency, the two sides are close to even. Anyone telling you only one side does this is not counting.

The asymmetry lives in three other places, and each one is a document that can be checked.

One side has a written instruction to merge its three words so the alarm transfers. I read it and quoted it on Wednesday. I searched for a counterpart on the other side and did not find one. Absence of a leak is not proof of absence, and the co/efficient memo leaked in four days, which tells you the pipeline works.

The other side’s own research shops have told it repeatedly to stop. Its 2024 general-election modeling ranked the fascism message far below its Medicare message on moving voters. Its 2025 research called authoritarianism messaging unconvincing. Its party committee’s late-2025 strategy memo went economic. Reporting from NOTUS in September 2025 shows Republicans making Democratic use of the word into the issue itself.

And then the third thing, which is not about rhetoric at all.

The word with a task force

The label currently attached to federal machinery is not fascist. It is anti-fascist.

Calling a president a fascist carries no consequence from the government. Being identified as anti-fascist can now put you inside a counterterrorism apparatus.

I am not the first to say this, and I am not going to pretend otherwise. Faiza Patel of the Brennan Center made the point on October 9, 2025, with the designation order and NSPM-7 quoted directly, and her formulation is better than mine: the antifascist label can be attached to almost anyone, and the flexibility is the point. Forrest Brown named the irony in November.

The record since: NSPM-7 names anti-capitalism among its indicators and tasks the Joint Terrorism Task Forces, Justice, Treasury, and the IRS. The 2026 counterterrorism strategy names anti-fascists as one of three major threat categories, and does not mention right-wing or white supremacist extremism at all. A July State Department report names the Democratic Socialists of America and the National Lawyers Guild.

I am flagging that last section as mine. The memo I wrote about on Wednesday says nothing about enforcement. The connection is my analysis, and you should weigh it as analysis.

What the reader did

Which brings me back to six words.

He read a correction addressed to the whole thread, recognized himself in it, and wrote that he was lazy and would be better. He did not argue. He did not reframe. He did not explain that he had meant something more defensible. He did not go quiet and reappear two days later with a hypothetical.

I have now read 76 pieces by people who write about this for a living, several of them with audiences a hundred times the size of mine. I did not find that sentence once.

The invitation

This is the part where a piece like this usually ends by feeling superior. I would rather it end by being useful, so I am going to ask instead.

To the writers named above. Send the receipts. Not a retraction and not an apology. A link. If there is a source for the claim that fascism requires a foreign war, send it, and I will run it. If there is documentation for the five hundred million dollars in a Qatari account, send it and I will run it. If Stephen Miller said the thing, send the quote and I will run it. Corrections and sources get published in full, at the top of the next Binding, under your own name, without commentary from me.

I am asking in good faith because I think most of this is a genre problem rather than a character problem. Snyder in 2024 met the standard. Reich meets it. Ben-Ghiat meets it in her essays. The standard is achievable by every writer on this list, because every writer on this list has already met it. What changed is cadence, and cadence is a choice. (I recognize my own limitations here.)

To my own readers, including the ones who disagreed with me on Wednesday. Apply this to me. I told you the memo was real and gave you its dates, its sample, and its margin of error. I told you which section was my analysis rather than the document’s. Hold Friday to the same rule you hold Wednesday.

And to everyone. The next time a piece tells you something is fascism or communism, ask it three questions. Which meaning? By what criteria? What would change the writer’s mind? If a piece cannot answer all three, it is asking for your alarm and offering you nothing concrete.

A note on method. I read 76 pieces across three sweeps: writers applying the fascist label, writers rejecting it, and writers arguing the communist and socialist labels. I graded each on whether a reader could check it. Substack’s own search is closed to automated tools, so everything here came through general web search, which means there is certainly good work on both sides that I did not surface. If yours is in that gap, send it. I would rather be corrected than uninformed.

Friday Binding: Who Opened It

Last Thursday I published a piece about 113 comments under the Orange County Register’s post on the fiftieth State of Black America. Not one of them referred to anything in the report. I called that contempt, and I stand on it.

Then I went looking for the people who did open it. A complaint about readers is cheap if you cannot name the readers who showed up.

The Associated Press story by Matt Brown ran in Fortune, the Philadelphia Inquirer, PBS NewsHour, NBC News, the Baltimore Sun, and dozens of local papers. I read it against the executive summary and counted the figures it carries from the report. Zero. That makes the week’s test easy. Any outlet publishing a number went past the wire.

Two did. I found no opinion column and no editorial board anywhere that engaged the document. I found no conservative or libertarian outlet that engaged it either, which is a change rather than a policy: Fox News covered the 2025 edition on July 25 last year, with a byline. This year the administration’s press shop supplied the entire right-of-center response.

The question: who opened it, and what did they find that the wire left out?

1. Antonio Mattox Jr., “Urban League report: As Black men lose jobs, Marc Morial blasts EEOC,” UATL, July 30, 2026.

Mattox writes under an Ida B. Wells Society line at UATL, the Atlanta Journal-Constitution’s Black culture desk. He did the thing nobody else did. Morial called the EEOC an embarrassment at the rollout, and Mattox picked up the phone and asked the EEOC to answer the charge.

It answered: “The agency is committed to ensuring a colorblind, merit-based, and evenhanded enforcement of the law … and to protecting workers of every race and both sexes, based on the merits of their claims.”

That statement appears in no other coverage I could find. Read it beside Morial’s line in the same piece: “The EEOC has become an embarrassment to America. The EEOC is refusing to do its job.”

The caboose is here too, and it is nowhere in the wire. Morial: “African Americans are like a caboose on a train. The train speeds up, the condition of Black Americans improves, but remains behind that of whites because they speed up as well.” Fifty years of a report in one mental image.

2. Ashleigh Fields, “Black Americans’ prospects worse under Trump administration: National Urban League,” The Hill, July 30, 2026, 3:08 p.m. ET.

The AP got the adjectives. Fields got two agencies and a footnote.

She quotes the report’s own hardest passage, which no wire reader has seen: “When the Secretary of the Department of War blatantly refuses to promote Black military leaders, fires them discriminately, and goes as far as to refuse to have them photographed with the sitting President, there can be no other explanation than racism.” She went to the Justice Department for a response and got one, from a spokesperson defending the Civil Rights Division under Assistant Attorney General Harmeet Dhillon: the division enforces the law “evenhandedly for all Americans,” and “preferential treatment on the basis of race has no place in our society.”

White House spokeswoman Allison Schuster supplied the position. A White House official supplied the arithmetic, and Fields did the thing that makes this pick: she linked the official’s source.

Between Mattox and Fields, three federal agencies answered on the record. Neither reporter got there by running the wire.

3. Joint Center for Political and Economic Studies, “May 2026 Jobs Day Analysis,” June 5, 2026.

This is the document the White House official cited, and following the link is where the week turned for me.

The Joint Center is the oldest Black-led think tank in the country. Its May analysis is the source of the administration’s number: Black employment rose by 101,000 between April and May 2026. I checked it against BLS series LNS12000006, which puts Black employment at 20,442,000 in April and 20,543,000 in May. The difference is 101,000, exactly. The official’s number is real and it came from a Black research institution’s own work.

Two things sit in that same analysis and did not travel with the number.

The Joint Center reports the Black unemployment rate falling from 7.3 percent to 6.6 percent. That is 0.7 points. The White House official told The Hill the rate “fell 0.6 percentage points in May.”

And a few lines down: Black unemployment was 6.0 percent in May 2025 and 6.6 percent in May 2026. Higher than a year ago, and, in the Joint Center’s words, still “the highest among the major racial groups.”

The month improved. The year did not. The official quoted the month.

I wrote three days ago that a columnist “had the rankings and left out the armed guards,” and that this is a curation choice rather than a factual error. Here is the same strategy, from a different direction, inside a document anyone could have opened by clicking the link The Hill already provided. I did not expect to find it while writing this Binding, and I am putting it in the third slot because it is the strongest thing the week produced.

4. Valerie Wilson, “A snapshot of Black employment trends under Trump 2.0,” Economic Policy Institute, May 4, 2026.

Wilson directs EPI’s Program on Race, Ethnicity, and the Economy. Before that, she was an economist at the National Urban League’s own Policy Institute. She published this three months before the report, and it is the closest thing that exists to a methodological check on the report’s headline number.

The executive summary says: “Between November 2025 and February 2026, approximately 567,000 Black men lost their jobs.” Wilson looks at the same series and refuses to run that comparison. Her reason, in her words: “shifts in the demographic composition of the population also resulted in larger than usual discontinuities in labor force measures by race, ethnicity, and gender between December 2025 and January 2026—which is why this analysis is focused on a comparison between the first quarters of 2025 and 2026, when the population controls are the most up to date.”

She reaches the same direction the report reaches. Black men’s employment-population ratio fell from 60.5 percent to 58.8 percent between the first quarters of 2025 and 2026. She gets there on ground that is stable.

I flagged this figure last Thursday. Learning that a former Urban League economist had flagged it in public, in May, is the most useful thing this week’s reading gave me.

5. 2026 State of Black America: Is the American Dream Dead? National Urban League, July 30, 2026.

Fiftieth edition. Executive summary is a free PDF, no login, about fifteen minutes.

Morial wrote it with Senators Raphael Warnock, Angela Alsobrooks, and Lisa Blunt Rochester, Governor Wes Moore, and Mayors Jacob Frey and Brandon Scott. Three sections: Defeat Poverty, Defend Democracy, Demand Diversity.

The third section carries an argument overlooked by most. The report wants Black entrepreneurs positioned inside “the industrial revolutions underway in AI, clean energy, and biomedical technology,” and it puts the stakes plainly: “The next economy is being built today. Who builds it will determine who benefits from it for generations.”

It also names the reader’s job. “When Washington retreats, statehouses must advance.”

Agree or disagree. You cannot do either from the wire copy.

The small install: read the wire against the document

Fifteen minutes, and it works on any report in any news cycle.

Count the numbers in the wire story. For the AP piece on this report, the count is zero. That tells you what several million people read: the existence of a report, plus quotes.

Open the document and find one figure the wire left out. Now you know something those readers do not.

Follow every link in the rebuttal. The Hill printed the White House’s source. Clicking it took me under a minute and produced the third pick above. Most rebuttals do not cite anything. When one does, that is insight.

Landing

I broke two of this report’s numbers last Thursday, and the executive summary confirms both readings.

The Medicare line says “approximately $500 billion in cuts from 2027–2034.” Congress wiped the PAYGO scorecard clean in November 2025, which killed the trigger. The Black women figure reads “250,000 to over 300,000 … with some estimates reaching 600,000.” The 600,000 has no traceable source I can find. And the $87 billion arrives as “These job losses cost Black America about $87 billion in lost income,” which attaches Algernon Austin’s CEPR figure to the 567,000. Austin measured one year, 2025, against a counterfactual where Black and white employment rates match. He drew no such chain.

The wealth gap holds. The homeownership gap holds. The Civil Rights Division holds. Callais holds.

So the week ends with a document that is mostly sound and partly stale, a White House that answered it with a Black think tank’s research and quoted the better month out of it, and an American press that ran a wire story carrying none of the numbers in dispute. Every one of those is a reading failure, and they are not the same size.

Two of the report’s mechanisms are voting mechanisms. Louisiana v. Callais narrowed Section 2 of the Voting Rights Act on April 29. The SAVE Act died in the Senate on June 4 by filibuster rather than by argument. The report’s own instruction is that statehouses advance when Washington retreats, and statehouses are down-ballot. How Exactly?

A note before you read. This is Thursday, not Friday. Usually, you would be getting the Friday Binding. However, the OC Register story hit this afternoon, and I read 113 comments under the Facebook post and could not let it sit through the weekend.

I have been quiet this week because I have been thinking hard about where we are and what my job is inside it. That is Monday's piece. I will pick up the regular cadence from there.

That comment sits a few slots below this one:

“Did they bother to say how? Or just orange man bad?”

This was from the same thread, this evening. The Orange County Register posted the Associated Press story on the National Urban League’s fiftieth State of Black America report, and the readers produced 113 comments in about four hours.

I read each and every one of them before I wrote anything.

I determined that not a single comment refers to anything in the report.

Nothing about the Justice Department. Nothing about the Equal Employment Opportunity Commission. And nothing about Louisiana v. Callais, decided in April, which gutted the operating standard of the Voting Rights Act. Not the SAVE Act, which the AP story names by title. Nothing about homeownership, unemployment, the federal workforce, one figure, one page, or one line of the report.

However, six people demanded to know the mechanism. Roughly ten declared the report false outright.

They did not read the report.

I read every one of the 113 comments before I wrote a word of this. Not a single one refers to anything in the report.

Call it what it is

Marc Morial served as mayor of New Orleans for eight years and as a Louisiana state senator before that. A commenter called him “fat Albert.”

Really?

Another wrote “Black fatigue.”

The fatigue is all mine, pal.

Another reproduced a racial slur in full, presenting it as a historical quotation.

Another wrote that Africans and Muslims sold their own into slavery, under a post about federal civil rights enforcement in 2026.

Yeah, they wrote that.

Several wrote versions of the same sentence. Blacks do it to themselves; they hinder themselves; they have fatherless families. Then there was the black-on-black violence. Or, and the entitled mindset.

You can not claim these are edgy jokes, and they are also not political disagreement. They are the thing the report describes, posted in the comment section beneath a story about the report, by people who did not read it (ridiculous). The Orange County Register published an article asking whether Black Americans face structural barriers to advancement. Its own readers answered the question in four hours, in public, under the paper’s masthead, with no moderator anywhere in sight.

The comments prove the report.

This is also not ignorance

I want to be precise about what happened here, because the polite word for it is wrong.

Ignorance is not knowing. Ignorance is forgivable, and it is fixable, and it describes a condition rather than a choice.

Every one of these people had the document one click away. The Register put the link in the post. The AP story names the mechanism in its fifth paragraph. The full report and its executive summary sit on a public website with no paywall and no login. Reading the executive summary takes about fifteen minutes.

They chose the comment box.

Capacity failure? No, that behavior is contempt, and contempt is a decision. Somebody decided the document was not worth fifteen minutes and the comment was worth typing anyway. Somebody decided that demanding evidence and refusing to look at evidence could be the same act. Six people performed a standard of proof they had no intention of applying to themselves.

I spent twenty-three years in an institution that will not let you argue about an operation until you have read the order. Disagree with the order all you want. Skip it, and you are not in the conversation. That rule exists because people who argue about documents they have not read get other people hurt.

Ignorance is not knowing. Every one of these people had the document one click away and chose the comment box. That is contempt, and contempt is a decision.

The mechanism

The Justice Department’s Civil Rights Division lost roughly 250 attorneys between January and the end of May 2025, about 70 percent of its lawyers. Assistant Attorney General Harmeet Dhillon described her goal as turning “the train around and driving it in the opposite direction.” The division’s published mission statements now include protecting children from chemical and surgical mutilation, keeping men out of women’s sports, and eradicating anti-Christian bias. Voting, education, and special litigation took the heaviest losses. Senator Peter Welch requested oversight hearings in April 2025 and again in October.

The Equal Employment Opportunity Commission lost its quorum in January 2025 when two commissioners were fired. It could not issue guidance or approve major litigation until the Senate confirmed a third member in October. Andrea Lucas became chair on November 5. The commission has since deprioritized disparate impact claims and taken the position that disparate impact suits are unconstitutional.

Hold that one, because the thread gets it exactly backward. No court has held that diversity programs violate the Fourteenth Amendment. Students for Fair Admissions, Croson, Adarand, and Parents Involved addressed race-conscious college admissions, government contracting set-asides, and K-12 school assignment. An agency adopting an enforcement posture is not a court issuing a holding. Anyone who tells you different should be asked which case, which practice, which ruling, and should be expected to answer.

Louisiana v. Callais was decided April 29 of this year, six to three, Justice Alito writing. Section 2 of the Voting Rights Act now requires evidence supporting a strong inference that a state intentionally drew districts to give minority voters less opportunity because of race. Section 2 operated as an effects test for sixty years. It is now close to an intent test, with a partisan-motive defense available to any state that wants it. Districts drawn to comply with Section 2 are now exposed to challenge as racial gerrymanders. Alabama is moving on two majority-Black Senate districts. Mississippi is redrawing its Supreme Court districts.

The federal workforce shrank by 271,825 employees between September 2024 and January 2026, a 12 percent contraction. Black Americans held roughly 19 percent of federal jobs while making up 14 percent of the population. Black women lost 95,371 of those positions in 2025, about a third of the total. Among Black women with bachelor’s degrees, labor force participation fell 3.5 points in one year.

Four claims. Every one verifiable from the Supreme Court’s own opinion, the Justice Department’s own website, and federal employment data. None of them require anyone to trust the Urban League about anything.

That took me an afternoon. It was available to all 113 of them.

Now the part that costs me something

I checked the Urban League’s numbers too. Two of them fail, and I am going to say so in the same piece where I defend the rest, because that is what checking means.

The report says the reconciliation law triggers roughly $500 billion in Medicare cuts from 2027 to 2034. The Congressional Budget Office did produce that estimate under statutory pay-as-you-go rules. Congress then wiped the $3.4 trillion PAYGO scorecard clean in the November 2025 law that ended the shutdown, which killed the trigger. A report published on July 30, 2026, states a canceled contingency in the present tense. That is eight months stale, and somebody should have caught it.

The report says 567,000 Black men lost jobs between November 2025 and February 2026. The arithmetic replicates from the Bureau of Labor Statistics series. Nearly all of it is a measurement artifact. BLS delayed its annual population control adjustment and folded it into the February 2026 release, which cut the measured employment level by about 1.4 million, and the agency warned against comparing February figures with earlier months. The December-to-January move alone accounts for 536,000 of the drop. There is also no October 2025 household survey, because of the shutdown, so the series has a hole immediately before the window opens.

The $87 billion in lost income paired with that number comes from the Center for Economic and Policy Research and measures something else: the annual cost of the employment gap across all Black workers in 2025. Setting the two figures side by side implies a causal chain CEPR never drew.

The claim that anti-diversity policy cost between 250,000 and 600,000 Black women their jobs in 2025 has an upper bound with no traceable source. The Institute for Women’s Policy Research found a net loss of 113,000. The Economic Policy Institute found the steepest one-year drop in Black women’s employment rate in 25 years, attributed the college-graduate losses mainly to federal layoffs, and stated plainly that why the damage concentrated on Black women remains an open question.

The wealth gap holds. The homeownership gap holds. The Civil Rights Division holds, the EEOC holds, Callais holds, the federal workforce numbers hold. The Medicare figure does not. The 567,000 does not.

Notice what I just did, though. I spent four paragraphs holding the organization I am defending to a standard, in public, in the same essay. Not one person in that comment section held anyone to anything, including themselves.

The ladder

The thread climbs, and each rung requires less knowledge of the document than the one below it.

Demand evidence without reading. Six comments. Then deny with no argument at all: fake news, a total lie, another lie, more liberal lies, no because it’s not true. Then attack the funding. “Just go see who Funds the Urban League... duh.” Then swap in a different cause, which is where the fatherless families and the entitled mindset arrive, relocating the argument to ground where the Civil Rights Division has nothing to say. Then reverse the charge: race hustlers, race baiters, “these clowns are the racist,” “the lying racists continue to promote hate and division.” Then attack the paper for printing it. Then cancel the subscription.

By the top of the ladder, the report has disappeared, and the argument is about whether a newspaper should have carried a wire story. Nobody needs to know what the story said to have that argument. That is the entire appeal.

Two commenters called the report a new narrative. The first State of Black America came out in 1976, written because Gerald Ford’s State of the Union and the Democratic response both skipped Black economic conditions. The New York Times called it “a profoundly depressing document.” Jimmy Carter adopted several of its recommendations after winning that November. The AP story gives that history four paragraphs.

They called a fifty-year-old annual publication new. The correction was one click away. Nobody took the click.

Two quotes, both broken

A commenter quoted Lyndon Johnson, reproducing a racial slur in full, on having Black Americans “voting Democrat for the next 200 years.” That line traces to exactly one source: Ronald Kessler’s 1995 book Inside the White House. Kessler got it from Robert MacMillan, an Air Force One steward, who said he overheard Johnson say it to two governors around the time of the 1964 Civil Rights Act. MacMillan was recalling the moment more than thirty years later. No contemporaneous record exists. Snopes rates it unproven.

Somebody published a slur in a public forum, under a newspaper’s name, on the strength of one man’s decades-old recollection. He did not check. He was not going to check. Checking was never part of it.

Two commenters invoked Charles Barkley. Barkley did say something close. On Michael Smerconish’s show in September 2019 he said Democrats “have been taking black people’s votes” and “only talk to black people every four years,” doing nothing in between. In the same stretch he said, “Neither one of these parties is doing a thing for poor people,” and that Republicans do not talk to Black voters at all.

They kept the half that indicts Democrats. One version had Barkley laughing at the idea that white people are to blame for everything that happens to Black Americans, which he never said, and which required inventing a claim about white people so it could be knocked down. The report names federal agencies and a Supreme Court decision. It names no race of person anywhere.

He did not check. He was not going to check. Checking was never part of it.

The subscriber

The longest comment came from a reader announcing she would cancel. It contains one accurate grievance wrapped around a demand that would end journalism.

The grievance: “I understand that you let go a lot of the local writers and now we’re looking at articles from people who don’t even live in this state.” She is right about that. MediaNews Group has cut Southern California newsroom staff repeatedly, and the Register runs far more wire copy than it did ten years ago. She is a paying customer describing a product that got worse.

The demand: “Just reflect the readership. Stop trying to put your thumb on the scale. It’s no longer true journalism when they do that. It’s propaganda.”

The story she is describing is an Associated Press report by Matt Brown that summarizes a document, quotes the organization that produced it, and quotes White House spokesperson Allison Schuster rebutting it at length. That is the standard construction, executed correctly.

Her position is that reporting the existence of a report is bias, and that the cure is for a newspaper to mirror its audience back to itself. She invoked a traditional journalism background while making that argument. Reflecting the readership is the one thing that background teaches you never to do.

She wants more local reporters and less reporting she disagrees with. Alden Global Capital gave her the first problem. She aimed at the Associated Press.

What this actually is

Two of the four answers above are voting cases. Callais narrowed the Voting Rights Act in April. The SAVE Act would require documentary proof of citizenship to register, and it died in the Senate on June 4 by filibuster rather than by argument. Both will be settled by people who know what is on their ballot, in state legislative races and local ones, where the redistricting actually happens.

The 1976 report changed federal policy because a man running for president read it during an election year. That is the whole mechanism, and it has never been more complicated than that.

Somebody read the document.

One hundred thirteen people had the chance yesterday. Six of them demanded the evidence out loud. The rest called it a lie, or called the organization a hustle, or called a former mayor fat Albert, or typed a slur and hit post.

Todd Udell asked how exactly.

Sunday night, Keith Hammond replied to the Rogers Quiet Rewrite thread from his own memory. Another Marine. He recalled the President’s House removal from the year before — replaced after uproar, then quietly revised to strip the enslaved of their identities. He named the pattern before I linked it publicly. His line:

“The same people who were fine with putting skin color on water fountains and bathrooms, now have issues with putting it on depictions of courage, heroism, and honor.”

Presidents’ Day, February 16, 2026. Judge Cynthia M. Rufe ordered the National Park Service to put the panels back at Sixth and Market. The judge wrote forty pages. The administration’s argument, she wrote, was “dangerous” and “horrifying.” She invoked the Ministry of Truth in Orwell’s 1984. The next morning, I published an essay “Version Control for Democracy in a Ghost-Map Age.” I found Michele Norris’s Substack post the same day titled “Say Their Names.” It is crazy to think that two writers on the same platform on the same day, using the same word to explain what was going on: restore.

Wednesday night, July 15, 2026, a work crew was dispatched to the site with a different set of panels for Sixth and Market. The panels had been “manufactured,” an Assistant U.S. Attorney told the Third Circuit on July 2. The court cleared its mandate on July 3. The installation finished before sunrise on July 15. It was done “under cover of darkness,” according to Mayor Cherelle Parker’s office.

All nine names are still there; however, the story around them was rewritten.

Coe wrote You Never Forget Your First: A Biography of George Washington (Viking, 2020). 2. Michele Norris, “THE REWIND: Say Their Names,” The Race Card Project on Substack, February 17, 2026.

Norris founded The Race Card Project in 2010 to collect six-word stories about race from ordinary people. Her Substack post landed the day after Judge Rufe’s Presidents’ Day injunction. Her argument: naming enslaved people in public history is what keeps them from being enslaved a second time by omission. She wrote it in February about the removal. The Third Circuit’s June 18 opinion vacated the injunction that made her sentence true. Read Norris against the July 15 panels. Note what she asked for. Note what got kept — the nine names in cement — and what got moved into a smaller panel that emphasizes Washington’s trust in “his enslaved house staff” and buying them theater tickets.

5. Erica Armstrong Dunbar, Never Caught: The Washingtons’ Relentless Pursuit of Their Runaway Slave, Ona Judge. Atria Books, 2017.

Ona Judge escaped from the President’s House on May 21, 1796. She lived free in New Hampshire for the next fifty-two years and refused the manumission Washington’s estate later offered, because acceptance would have recognized his family’s ownership of her. Her footsteps are cast in the pavement at the site. Dunbar’s book is why. Dunbar is the Charles and Mary Beard Professor of History at Rutgers and a MacArthur Fellow. Read the book this weekend. The small install: a three-step audit

When an institution you track announces a restoration, log three things the same day.

Set a reminder thirty days out to compare again.

The quiet change depends on nobody coming back. The Rogers page went unnoticed for fifteen months because we did not come back to check. The President’s House panels are the same mechanism playing out live. We need to keep the watch.

Landing

The court order was the legal command to restore. The Third Circuit called it invalid on June 18. The overnight installation on July 15 was the final commit. Version control for democracy describes what a citizen does when the institutional substrate becomes editable in the middle of the night.

State’s official Facebook page carried the line “poisonous resentment cloaked in the language of equality, justice, and liberation.” The ministerial has a name: the Resurgence of Political Terrorism. The rhetoric is the visible layer. The five picks below trace the machinery underneath.

1. Where the machinery lives

Ken Klippenstein, “Exclusive: FBI’s New Political Pre-Crime Center.” April 6, 2026.

The FBI stood up an NSPM-7 Joint Mission Center. Its job is to flag people whose beliefs match a list — anti-American, anti-capitalist, anti-Christian, opposition to traditional views on family and religion. The trigger is what people think. The center integrates intelligence, operational support, and financial analysis. Klippenstein has been on this since September, when NSPM-7 first appeared. This piece is where the architecture stops being abstract.

2. The language on paper

Democracy Now!, interview with Ken Klippenstein. December 8, 2025.

A leaked DOJ implementation memo defined the targets. Each criterion is a belief. “Anti-American, anti-capitalist or anti-Christian.” “Opposition to law and immigration enforcement.” Support for “radical gender ideology.” “Hostility towards traditional views on family, religion, and morality.” NSPM-7 authorized the Treasury Department to audit nonprofit taxes for foreign-financing evidence, told the FBI to review five years of past intelligence records, and set up a citizen reporting system. This transcript is where the categories get named in the government’s own words.

3. The insider says the framework does not fit

NPR, “U.S. adds 4 European leftist groups to foreign terrorism list.” November 21, 2025.

Jason Blazakis ran the State Department’s FTO designation office through the Obama and first Trump administrations. He was asked whether the four European groups the State Department just designated — Antifa Ost in Germany, Informal Anarchist Federation in Italy, Armed Proletarian Justice and Revolutionary Class Self-Defense in Greece — met the standard. His answer: “These wouldn’t really typically merit an FTO designation because they hadn’t been responsible for fatalities yet.” Ten years at the office. Naming a category error.

4. What the allies said

Washington Post via The Spokesman-Review, “Rubio tries to enlist other nations in antifa fight, but some allies recoil.” July 9, 2026.

European diplomats speaking on condition of anonymity: “We don’t have antifa.” Another: their “law enforcement authorities have not focused on left-wing terrorism because this is not considered a high-priority threat.” The Netherlands declined to co-host a May planning meeting on the same topic. Thomas Renard of the International Centre for Counter-Terrorism, quoted the day of the ministerial, said counterterrorism “has been completely politicised, instrumentalised,” and that right-wing terrorism has “completely disappeared from the U.S. counterterrorism strategy.” When the allies are sending junior ministers to a foreign-policy summit, the message is legible.

5. The historical rhyme

Ken Klippenstein, “Leak: Rubio’s WMD Scandal Is ‘Far-Left Terrorism’.” July 15, 2026.

Klippenstein got the ministerial planning documents the day before Rubio took the podium. His line lands hardest: “A three-letter acronym for an imaginary threat that could be radioactive to a politician’s presidential ambitions. Sound familiar? It’s this generation’s WMD.” The FTO framework was built for al-Qaeda, ISIS, and Hamas. Groups with command structures, membership rolls, operational tempo. Applied to an ideology, it becomes the pretext. That is the shape of WMD.

The small install: a reader’s tool from 1936

Clyde Miller and Violet Edwards published a field guide for teachers in The Clearing House in October 1936. Seven propaganda devices, meant to teach a child to read a political ad. Their list still works. Try it on the State Department’s Facebook post, three sentences long.

Name-calling. “Radical leftism.” “Poisonous.” “Ugliness.” “Menace.” Four in three sentences.

Glittering generalities. “Equality, justice, and liberation.” The words the reader is being taught to distrust.

Transfer. The State Department seal. The podium. The backdrop reading “The Resurgence of Political Terrorism,” which puts the target in the same visual frame as al-Qaeda, ISIS, and Hamas without having to name them.

Testimonial. 65 foreign delegations in the room. Attendance is the message.

Card-stacking. No mention of right-wing political violence, which the same counterterrorism data ranks higher. (Same move, one week apart: see Restoring Whose Truth? Revisited.)

Plain folks. “We must confront this menace together.” The Secretary of State speaks in the register of a neighborhood watch.

Bandwagon. The event is named Resurgence. The framing is that this is what serious countries do now, and the room is proof.

All seven, one Facebook post. Miller and Edwards wrote in the 1930s because they had watched propaganda organize whole countries. Their bet was that a small guide, learned young, keeps the machinery visible. Ninety years later, on the State Department’s own feed, every device is present and every one is working. Anyone can name them once they know the names.

Monday

Wayne Coy’s guest essay lands Monday. He asks a definitional question: what gets called violence, and what does not. He walks through three things that happened on the same July 4 weekend. The White House Domestic Policy Council report recommending loyalty labels at Smithsonian entrances. A Black woman on a DC Metro train surrounded by masked Patriot Front marchers carrying Confederate flags. Flock Safety cameras cut down across five states, after audits showed one city’s data had been searched 7,100 times for immigration enforcement in violation of that city’s own policy. The march got a police escort. The woman got her dismissed 2024 charges spread across the internet. The camera-cutters face felony charges and, in some jurisdictions, the label “domestic terrorist.” The company that scans 150 million vehicles a day without warrant gets a contract renewal. Wayne names the pattern: the definition of violence decides which acts require accountability and which get to keep running. Same mechanism the Binding traced today. Different scale.

The through-line, restated

If ideology becomes an FTO-eligible category, what stops the next administration from designating the ideology it opposes?

That is the question the next Congress will inherit, whether or not it takes it up.

Friday Binding: The Guild Answered

Wednesday afternoon, my brother sent me a link. New York Times. Culture section. Headline: “Historians Reject White House’s Criticism of Smithsonian Museum.”

I already had a Facebook post cued up for Thursday morning (here). A portrait card of Lonnie G. Bunch III, three facts, one line about the 162-page report the White House Domestic Policy Council dropped on July 4. My frame was Bunch’s own answer: a memo about a 180-year mission and the Board of Regents who govern the institution.

The Times piece went one register deeper. The professional historians answered too. They spoke through their institutions.

That is what this Binding names.

The book on my desk

Alfred Korzybski, Manhood of Humanity (1921).

Korzybski coined the phrase “time-binding class of life” in this book. It has been on my desk since March 2025, when I started tracking the White House’s push on public history. Korzybski’s argument is simple. Animals live and die inside their generation. Humans do not. We pass the record forward, generation to generation, so the next group starts where the last one stood. Museums, professional associations, and archives are the mechanism. That mechanism is what the DPC report attacks. When the record-keeping breaks, the next generation inherits a map that does not match the terrain.

Albert Einstein famously referred to Alfred Korzybski's 1933 magnum opus, Science and Sanity, as "That's a crazy book!"

The guild answered

The Organization of American Historians is the largest professional body of U.S. history scholars in the country. On Monday, July 6, its board released a statement on the DPC report. Marc Stein, the OAH president, a professor at San Francisco State and the author of a 2026 history of the 1976 Bicentennial, sent a separate note to the Times. His line was the tightest thing said all week:

“Released on July 4, 2026, the 250th birthday of the U.S. Declaration of Independence, the report is a declaration of independence from history.”

The American Historical Association, more than 10,000 members strong, sent Sarah Weicksel, its executive director. She answered the method. Museum labels, she reminded reporters, should read at an eighth-grade level, and most visitors read no more than a brief label anyway. The DPC treats museum labels like textbook paragraphs. Weicksel names the confusion for what it is: a category error.

Updated yesterday morning. On July 9, the AHA published an escalation. In an updated statement, the Association wrote that the DPC report “attacks the independence of our National Museum of American History” and “severely limits whose experiences count as important to American history.” The AHA also linked the July 4 report to two earlier documents: the August 12, 2025 White House letter to the Secretary announcing a review of eight museums, and the March 27, 2025 executive order “Restoring Truth and Sanity to American History.” The AHA’s March 31, 2025 statement already carries 36 organizational signatures, from the Association for the Study of African American Life and History to PEN America to the Society of American Archivists. The July 9 update is the trailhead of a bigger coalition.

That is guild work. Read the report. Name the method. Show the receipts. Stack the signatures.

The receipt future readers get

If someone opens a search bar in 2036 and types “white house smithsonian july 4 2026,” here is what they find.

A 162-page report titled “Saving America’s Story.” A memo from the founding director of the National Museum of African American History and Culture defending the institution he built — the Washington Post published the full text on July 8. A July 6 statement from the professional body of U.S. history scholars naming the report as a partisan attack dressed as historical critique. A July 9 statement from the largest historical association in the country calling the report an attack on the Museum’s independence, backed by 36 organizations that already signed on to the AHA’s March 2025 defense. A national NPR wire pickup on July 9 running under the headline “Smithsonian chief emphasizes ‘accuracy and integrity.’”

Five documents. Two positions. Full record.

The angle the news pieces underplay. Tisby is a historian of the Black church and a plain-spoken reader of what the DPC actually wrote. The report’s complaint that the museum understates Christianity’s “constructive role” in the nation’s founding says the quiet part out loud. Tisby names the mechanism. Once you can name a mechanism, you can answer it.

5. Lonnie G. Bunch III, A Fool’s Errand: Creating the National Museum of African American History and Culture in the Age of Bush, Obama, and Trump. Smithsonian Books, 2019.

The book behind the man. Bunch built the museum brick by brick and wrote the account of doing it. When a report tells the founding director what the museum should say, the founder’s own book is the receipt. His chapter on legitimacy reads like it was written for this week.
